{"id":10735,"date":"2020-10-05T10:43:52","date_gmt":"2020-10-05T14:43:52","guid":{"rendered":"https:\/\/www.prisonpolicy.org\/blog\/?p=10735"},"modified":"2021-03-11T17:18:20","modified_gmt":"2021-03-11T22:18:20","slug":"checks-update","status":"publish","type":"post","link":"https:\/\/www.prisonpolicy.org\/blog\/2020\/10\/05\/checks-update\/","title":{"rendered":"Update: Court says IRS can\u2019t deny economic stimulus payments to incarcerated people"},"content":{"rendered":"<p>\n<a href=\"https:\/\/www.prisonpolicy.org\/blog\/2020\/05\/18\/checks\/\">As we noted back in May<\/a>, when most Americans were getting one-time $1200 stimulus payments from the IRS, the government was quietly trying to deny making payments to incarcerated people, even though there is no such restriction in the law that created this program. Plenty of people noticed the government&#8217;s lack of a solid basis for denying the payments, and at least two lawsuits over the issue are pending in federal courts.\n<\/p>\n<p>\nOn September 24, 2020, a judge in California <a href=\"https:\/\/www.lieffcabraser.com\/pdf\/document-50.pdf\">issued a ruling<\/a> requiring the IRS to process stimulus payments for incarcerated people. This isn&#8217;t quite the end of the story. The judge&#8217;s ruling could be stayed or reversed on appeal, or Congress could amend the law to prohibit payments to incarcerated people.<sup id=\"fnref:1\"><a href=\"#fn:1\">1<\/a><\/sup> But for the time being, IRS is accepting mailed applications from incarcerated people <a href=\"https:\/\/www.lieffcabraser.com\/cares-act-relief\/\">through November 4<\/a> (extended recently from October 30 because of a <a href=\"https:\/\/www.lieffcabraser.com\/pdf\/order-denying-stay.pdf\">court ruling<\/a>) and online applications through November 21.\n<\/p>\n<p>While the Prison Policy Initiative cannot provide legal advice, a basic explainer and instructions are <a href=\"https:\/\/www.uplcchicago.org\/stimulus\/\">available from the Uptown People&#8217;s Law Center<\/a>.
