{"id":1243,"date":"2013-11-14T13:00:46","date_gmt":"2013-11-14T17:00:46","guid":{"rendered":"http:\/\/www.prisonpolicy.org\/blog\/?p=1243"},"modified":"2022-04-08T10:12:49","modified_gmt":"2022-04-08T14:12:49","slug":"alabama-comment","status":"publish","type":"post","link":"https:\/\/www.prisonpolicy.org\/blog\/2013\/11\/14\/alabama-comment\/","title":{"rendered":"Alabama should implement proposed prison phone reform"},"content":{"rendered":"<p>\n  The <a href=\"http:\/\/www.psc.state.al.us\/\">Alabama Public Service Commission<\/a> is still <a href=\"https:\/\/www.pscpublicaccess.alabama.gov\/pscpublicaccess\/ViewFile.aspx?Id=ae43fe84-bbfb-483c-94ed-efd419ba1804\">seeking comments<\/a> on a <a href=\"http:\/\/web.archive.org\/web\/20140218205019\/https:\/\/psc.alabama.gov\/Telecom\/Engineering\/documents\/Sub_Ala_ICS_Reform_Order.pdf\">recent order<\/a> proposing to cap all prison and jail call rates and place strict limits on fees and other charges (<a href=\"\/blog\/2013\/10\/09\/alabama-proposes\/\">summarized here<\/a>).\n<\/p>\n<p>\n  Yesterday, we submitted the following letter in support of the Commission&#8217;s proposed regulations:\n  <\/p>\n<blockquote>\n<p>\n    November 13, 2013\n   <\/p>\n<p>Walter L. Box 304260<br \/>Montgomery, AL 36130\n<\/p>\n<p>\nDear Commissioners:\n<\/p>\n<p>\nWe are writing in support of your Order Proposing Revised Inmate Phone Service Rules (Oct. 7, 2013, Docket 15957).<a href=\"#_ftn1\" name=\"_ftnref1\" title=\"Our legal director, Aleks Kajstura, reviewed your proposal in light of our own findings on the high costs of prison and jail phone calls in \u201cAlabama seeks to curb high cost of prison and jail phone calls\u201d available at http:\/\/www.prisonpolicy.org\/blog\/2013\/10\/09\/alabama-proposes\/.\" class=\"footnotereference\">[1]<\/a>   As the Executive Director and Legal Director of the Prison Policy Initiative, we have investigated the high cost of calls from correctional facilities and would first like to thank you for addressing the issue of fees in your proposal.\n<\/p>\n<p>\nWe believe that regulating fees is an integral part of comprehensive regulation of prison and jail phone companies, and we commend Alabama for being the first state to, in our knowledge, directly address this major but hidden part of the industry.\n<\/p>\n<p>\nOur research found that fees make up 38% of the $1 billion customers spend on prison and jail phone calls each year.<a href=\"#_ftn2\" name=\"_ftnref2\" title=\"Please Deposit All of Your Money: Kickbacks, Rates, and Hidden Fees in the Jail Phone Industry, by Drew Kukorowski, Peter Wagner, and Leah Sakala (May 8, 2013), available at http:\/\/www.prisonpolicy.org\/phones\/pleasedeposit.html and attached.\" class=\"footnotereference\">[2]<\/a>   Your action to address fees is essential because simply capping rates would, as our report argues, be ineffective at protecting consumers if the industry was still free to continue to create additional fees out of thin air.\n<\/p>\n<p>\nWe agree with your conclusion that commissions paid to correctional facilities are ultimately to blame for both the high rates and fees charged by prison and jail phone companies.
