{"id":3858,"date":"2015-10-07T10:35:57","date_gmt":"2015-10-07T14:35:57","guid":{"rendered":"http:\/\/www.prisonpolicy.org\/blog\/?p=3858"},"modified":"2024-03-04T15:26:12","modified_gmt":"2024-03-04T20:26:12","slug":"private_prisons_parasite","status":"publish","type":"post","link":"https:\/\/www.prisonpolicy.org\/blog\/2015\/10\/07\/private_prisons_parasite\/","title":{"rendered":"Are private prisons driving mass incarceration?"},"content":{"rendered":"<p>In a word: No.<\/p>\n<p>Private prison companies have found ways to profit on America\u2019s experiment with mass imprisonment, but they are, to build on Ruthie Gilmore\u2019s analogy, less the seed or the fertilizer fueling mass incarceration and <span class=\"pullquote\" title=\"Private prisons are more like a parasite on the public prison system.\">more like a parasite on the publicly-owned prison system<\/span>.<\/p>\n<p>The vast majority of people incarcerated in this country are incarcerated in publicly-owned prisons. Only a small minority is in facilities operated by private companies under contract with states or the federal government. (And things get a little complicated because some &#8220;outsourcing&#8221; of incarcerated people goes not to private companies but to other governments. For example, <a href=\"http:\/\/doc.louisiana.gov\">almost half<\/a> of the state prison population in Louisiana is actually housed under contract with local parish governments.)<\/p>\n<p>This graph illustrates the late origin and limited impact of private prisons on the national landscape of state and federal prisons:<\/p>\n<p class=\"featureimage caption\"><img decoding=\"async\" src=\"\/\/static.prisonpolicy.org\/images\/private_prison_growth_to_2014.jpg\" alt=\"Graph showing that private prison growth has always trailed that of public prisons\" class=\"\"  \/>Note that the federal government didn\u2019t even bother to track the size of private prisons until 1999 and that we calculated the size of the government-run prisons by subtracting the private prisons from the total. The data from 1987 to 2001 was collected and published by an academic in Florida with a <a href=\"https:\/\/www.prisonlegalnews.org\/news\/1999\/sep\/15\/prison-realty-board-member-settles-ethics-complaints\/\">uniquely close relationship<\/a> with the industry. Due to different methodologies, the data aren\u2019t entirely compatible but together they show the birth and initial growth of the industry <b>follows<\/b> rather than leads the prison boom. The industry\u2019s long plateau in the last decade makes it clear that the private prison industry has largely been locked out of sizable growth.<\/p>\n<p>Now, of course, the influence of private prisons will vary from <a href=\"https:\/\/www.youtube.com\/watch?feature=player_detailpage&#038;v=_Pz3syET3DY#t=780\">state to state<\/a> and they have in fact <a href=\"http:\/\/www.alecexposed.org\/wiki\/Guns,_Prisons,_Crime,_and_Immigration\">lobbied to keep mass incarceration going<\/a>; but far more influential are political benefits that elected officials of both political parties harvested over the decades by being tough on crime as well as the billions of dollars earned by government-run prisons\u2019 employees and <a href=\"https:\/\/web.archive.org\/web\/20151006205601\/http:\/\/www.truth-out.org\/progressivepicks\/item\/33063-even-in-government-run-prisons-the-profiteering-off-of-human-lives-is-staggering\">private contractors and vendors<\/a>.<\/p>\n<p>The beneficiaries of public prison largess love it when private prisons get all of the attention. The more the public stays focused on the owners of private prisons, the less the public is questioning what would happen if the government nationalized the private prisons and ran every facility itself: Either way, we\u2019d still have the <a href=\"\/global\/\">largest prison system in the world<\/a>.<\/p>\n<p>But if private prisons aren\u2019t at the root of mass incarceration, that doesn\u2019t mean that <a href=\"http:\/\/www.american-securities.com\/Investments\/CurrentInvestments\/\">private investors<\/a> haven\u2019t found ways to make our criminal justice system worse. The sins of the prison and jail telephone industry trying to charge families $1 a minute for simple telephone calls are <a href=\"\/phones\/\">well-documented<\/a>. And the <a href=\"http:\/\/priceonomics.com\/americas-peculiar-bail-system\/\">private bail industry<\/a> keeps legislatures from passing sensible bail reforms that would allow <a href=\"\/blog\/2015\/08\/14\/jailsmatter\/\">poor, unconvicted people<\/a> who pose no public safety threat to wait for their trial at home rather than in jail.  <\/p>\n<p>What I find most worrisome is the rush of private money to fuel the development of &#8220;alternatives&#8221; to incarceration like <a href=\"\/blog\/2015\/08\/31\/segal\/\">electronic monitoring<\/a> or <a href=\"http:\/\/www.economist.com\/blogs\/democracyinamerica\/2015\/04\/private-probation-firms\">private probation services<\/a> that ensnare people who previously would never have been under criminal justice system control.
